01Acceptance of these terms

These Terms & Conditions ("Terms") are a binding agreement between you and Doseira, a brand of The Nelson M Group LLC ("Doseira," "we," "us"). They govern your use of doseira.com and related services, including email and text-message programs (the "Services"). By using the Services or submitting a form, you agree to these Terms, our Privacy Policy, and, if you opt in to texts, our SMS Terms. Do not use the Services if you disagree with any of this.

02What Doseira is, and is not

Doseira is an information service. We publish general, plain-language information about how clinical research works, how to read a study listing, what informed consent means, and which questions to ask a study team, and let visitors opt in to related updates. We never give medical advice, diagnosis, or treatment, do not run, recruit for, or enroll people in clinical studies, and do not match or refer people to studies or research sites, and we will not share your details with study sponsors, research sites, recruiters, pharmaceutical or device companies, lead-generation companies, or any other partners.

• Decisions about your health and about taking part in any research are yours. Reading our content does not obligate you to do anything.
• Your doctor and the study team, not Doseira, decide whether a study is right for you and explain its risks, procedures, and conditions.
• Every study is different. We do not guarantee that any study is safe, suitable, or open to you, or that you will qualify for or benefit from any research.

03Eligibility

To use the Services you must be 18 or older, be based in the United States, and have the capacity to enter a binding contract. Send us information only about yourself or about someone who has given you permission to do so.

04Your information and accuracy

You promise that what you submit is accurate and up to date, and you will update it if anything changes. The mobile number you enter must be one you own or have authority to use. If your number changes or is reassigned, please reply STOP from the old number or contact us so that we do not message someone else.

05Communications and text-message consent

Opting in means you agree to hear from us by email and, for the boxes you check, by automated texts as explained in the SMS Terms. Consent to texts is optional, is not a condition of purchase or of using the Services, and may be withdrawn at any time by replying STOP. Message frequency varies. Message and data rates may apply. Reply HELP for help.

06Text messaging: rates, frequency, STOP and HELP

Message and data rates may apply. Message frequency may vary (up to about 8 messages a month, depending on the topics you choose). Text START to join, or opt in with the form on our Get Started or text updates page. Consent is not a condition of purchase or of using the Services.

• STOP: Reply STOP to any message to opt out (STOPALL, UNSUBSCRIBE, CANCEL, END and QUIT also work). You will get one confirmation text and then no more messages.
• HELP: Reply HELP to any message for help, or contact us by email at [email protected] or by phone at 888-924-0126.

Mobile information and opt-in data are not sold or shared with third parties or affiliates for marketing or promotional purposes. See the Privacy Policy and SMS Terms.

07Acceptable use

The following are prohibited: (a) submitting false or misleading information, or information about someone else without authority; (b) unlawful, fraudulent, or abusive use of the Services; (c) disrupting the Services or attempting unauthorized access; (d) using bots or automation to submit forms; (e) copying, scraping, or reselling our content without permission; and (f) impersonating a person or entity. Breaking these rules may lead us to suspend or end your access.

08Third-party organizations and links

Organizations, programs, and products mentioned on or linked from the Services (say government agencies, hospitals, or patient organizations) are run by third parties. We do not endorse any product, plan, or provider and are not responsible for the conduct, content, or results of third parties. Your relationship with any doctor or study team is between you and them.

09Intellectual property

The Services, such as the Doseira name, logo, text, graphics, and design, belong to us or our licensors and are protected by intellectual property law. You receive a limited, revocable, non-exclusive, non-transferable license to view and use the Services for personal, non-commercial reasons. Photographs on the Site are used under their own free-use licenses.

10Disclaimers

The services and content come "as is" and "as available," without express or implied warranties like merchantability, fitness for a particular purpose, accuracy, and non-infringement. We cannot warrant that the services will be uninterrupted, error-free, or secure, nor that a message will be delivered or delivered on time.

Doseira does not supply financial, legal, or tax advice, and makes no representation about any medical outcome, study result, or eligibility.

11Limitation of liability

As far as the law allows, Doseira and The Nelson M Group LLC, and their members, managers, officers, employees, and agents, will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, or goodwill, arising from or related to your use of (or inability to use) the services, or from any health or research decision you make or do not make. Our total liability for any claim relating to the services will not exceed one hundred U.S. dollars ($100).

Because some jurisdictions restrict certain limitations, portions of the above may not apply to you. Nothing here limits liability that cannot lawfully be limited.

12Indemnification

You will indemnify and hold harmless The Nelson M Group LLC and its affiliates and personnel for any claims, damages, and expenses, including appropriate attorneys' fees, resulting from your violation of these Terms, misuse of the Services, or provision of a phone number or other information you were not authorized to give.

13Disputes, governing law, and arbitration

Informal resolution first. Before you file any claim, reach us at [email protected] and let us try to resolve it within 30 days.

Binding arbitration. Disputes between you and Doseira or The Nelson M Group LLC that arise out of or relate to these Terms or the Services (other than small-claims matters and injunctive-relief claims for intellectual-property misuse) will go to final and binding individual arbitration with the American Arbitration Association under its Consumer Arbitration Rules. The venue is your county of residence, or video or phone if you prefer. The arbitrator may give the same individual relief a court could, and a court of competent jurisdiction may enter judgment.

Class-action waiver. As permitted by law, each of us, you and Doseira, will bring claims only on an individual basis, and not as a plaintiff or class member in any class, collective, or representative proceeding.

Opt-out. You have 30 days after first accepting these Terms to opt out of arbitration, which you do by emailing [email protected] using the subject line "Arbitration Opt-Out" and giving your name and mobile number.

Governing law. The Federal Arbitration Act and the law of the state in which The Nelson M Group LLC has its principal place of business apply to these Terms, regardless of conflict-of-law rules. Where the arbitration clause does not apply, the state and federal courts in that state have exclusive jurisdiction.

14Termination

You may stop using the Services at any time, and may opt out of messages by replying STOP. Access may be suspended or terminated by us at our discretion, for example for violations of these Terms. Sections that by nature are intended to survive, including disclaimers, limitation of liability, indemnification, and disputes, remain in force after termination.

15Changes

From time to time we may update these Terms and will post the update with a new "Last updated" date. By continuing to use the Services after the effective date you accept the updated Terms. Notice of material updates will be given where required by law.

16General

This is the entire agreement between you and us on this subject: these Terms plus the Privacy Policy and SMS Terms. The remainder survives if any part is unenforceable; failing to enforce a provision does not waive it. You need our consent to assign these Terms, while we may assign them in a merger or a sale of the business.
